Michigan Car Accident Lawyers
Car Accident Lawyers in Michigan | Personal Injury Lawyer

Because Michigan is a no-fault insurance state, regardless of whether or not you were at fault in a car accident, your insurance company pays for most of your economic damages. This coverage is referred to as first party benefits. The benefits you are entitled to receive under a first party claim include payment of:
- Medical bills forlife
- Wage loss for up to 3 years
- Replacement services
- Attendant care
- Mileage reimbursement
- Prescription drug costs
Medical Bills for Life
Under Michigan law, medical coverage must continue for as long as treatment is needed, which in some cases could mean for life. Often insurance companies will dispute whether the treatment is necessary or whether the amount billed for treatment is correct. No future medical expenses are paid as benefits; the bill must be actually incurred.
If your auto insurance is based on uncoordinated benefits, the insurance company will pay all expenses regardless of whether you also have health insurance coverage or other insurance policies that may also cover auto accident injuries. If the auto insurance is based on coordinated benefits, the auto insurance company is required to pay expenses after your health insurance or other insurance carriers have paid costs under their policy.
Wage Loss
If you are unable to work as a result of the car accident, Michigan No-Fault Law requires that you should be able to receive 85% of lost wages for a period of up to three years. This is a tax free benefit with a cap set on monthly benefits paid by the insurance company.
Michigan Car Accident Lawyers | Replacement Services
Household services, errands, chores and any other services that you are unable to perform as a result of auto accident injuries are reimbursed by no-fault insurance for up to $20 per day. Your medical doctor must identify activities that you are unable to perform, documenting them in a written statement. Records of who performed the services on your behalf may also be required by the insurance company as part of the reimbursement procedure. Replacement services are only covered for up to three years after your accident.
Attendant Care
When you need assistance while recovering, Michigan law requires no fault insurance to cover attendant care, including 24-hour supervision, if necessary.
Mileage Reimbursement
Mileage to and from the location where you receive medical treatment is reimbursed under no fault insurance.
At Erlich, Rosen, Bartnick & Cook, Michigan Car Accident Lawyers, our injury lawyers routinely assist clients with issues that arise regarding first party benefits. A health insurance company and auto insurance company may dispute which company owes coverage, with neither paying the bills. Bills not received within one year of medical treatment do not have to be paid by the insurance company. In addition to handling this sort of issue, we also address whether our client is receiving correct wage loss benefits, handle refusals to pay attendant care along with other attempts to deny or pay less benefits than the amount entitled.
For legal help regarding first party benefits, consult with one of our personal injury lawyers. Our consultation is free and if we believe we can assist you, our fees are based on contingency with nothing owed unless we recover compensation on your behalf.
